Article 1: Preamble

The purpose of this privacy policy is to inform visitors or users (together, hereinafter “User”) of this website (hereinafter, the “Site”):

– How their personal data is collected. Personal data is any information that can be used to identify a User. Such information may include, but is not limited to, the User's full name, age, postal or e-mail address, location or IP address;

– On the rights they have concerning this data;

– Who is responsible for processing the personal data collected and processed?

– The recipients of this personal data;

– The Site's cookie policy.

Article 2: Principles relating to the collection and processing of personal data

In accordance with Article 5 of European Regulation 2016/679, personal data is:  

– Processed lawfully, fairly and transparently with regard to the data subject;

– Collected for specified (see Article 3.1 hereof), explicit and legitimate purposes, and not further processed in a manner incompatible with those purposes;

– Adequate, relevant and limited to what is necessary for the purposes for which they are processed;

– Accurate and, where necessary, kept up to date. All reasonable steps are taken to ensure that personal data which is inaccurate, having regard to the purposes for which it is processed, is erased or rectified;

– Kept in a form which permits identification of the data subjects for no longer than is necessary for the purposes for which they are processed;

– Processed in such a way as to guarantee appropriate security of the data collected, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

Processing is lawful only if, and insofar as, at least one of the following conditions is met:

– The data subject has consented to the processing of his/her personal data for one or more specific purposes;

– The processing is necessary for the performance of a contract to which the data subject is a party, or for the performance of pre-contractual measures taken at the data subject's request;

– Processing is necessary to comply with a legal obligation to which the data controller is subject;

– The processing is necessary to protect the vital interests of the data subject or of another natural person;

– Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

– Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, unless the interests or fundamental rights and freedoms of the data subject which require the protection of personal data prevail, in particular where the data subject is a child.

Article 3: Personal data collected and processed when browsing the Site

Article 3.1: Data collected automatically

When browsing the Site, the following data is automatically collected from the User:

– IP address,

– Browser type and version,

– Type of device,

– General geographical location,

– Pages visited and interactions with the Site.

The purpose of this automatic collection is to ensure the proper functioning of the Site, to perform statistical analyses and to optimize the User experience.

The legal basis is the legitimate interest of Reecall SAS in maintaining the security of the Site and improving its performance.

The data collected are kept by the data controller under reasonable security conditions for a period of 1 year.

Reecall may keep certain personal data beyond the above-mentioned periods in order to meet any legal or regulatory obligations it may have.

Article 3.2: Data voluntarily provided and collected

Other personal data is collected when the User carries out the following operations on the platform:

– Completion of contact forms,

– Subscribing to information messages or events,

– Downloading documents.

The data collected is provided voluntarily by the User, who has given his or her free and informed consent to the transmission of such data:

– Last name,

– First name,

– e-mail address,

– Company name,

– Telephone number,

– Job title.

Purpose: To respond to voluntary requests from the User.

Legal basis: Reecall's legitimate interest in responding to the User's requests or promoting its products and services.

The data are kept by the data controller in reasonable conditions of security, for a period of 3 years.

Reecall may keep certain personal data beyond the above-mentioned periods in order to meet any legal or regulatory obligations it may have.


Article 3.3 : Data hosting

Webflow is certified under the EU–U.S. Data Privacy Framework, the Swiss-U.S. Data Privacy Framework, and the UK Extension to the EU-U.S. Data Privacy Framework. Additionally Webflow’s DPA contractual clauses as its transfer mechanism to export data from Europe. Webflow’s Data Processing Addendum includes the EU Standard Contractual Clauses, the UK’s International Data Transfer Agreement and includes the contractual requirements placed on processors under the GDPR. Article 3.4 : Transmission of data to third parties

Reecall may share the User's data with the following categories of recipients:

– Third-party service providers: web hosting providers, cloud service providers, or those improving the security of the Site;

– Public bodies or competent third parties: where disclosure is necessary to comply with legal obligations, to protect rights, or to protect the vital interests of the User.


Article 3.5 : Cookies policy

The Site uses cookies and similar technologies to improve the User experience and analyze the use of the Site. The cookie manager accessible on all pages of the Site provides information and enables the User's wishes regarding the activation or non-activation of cookies to be managed.

Article 4: Data controller and Data Protection Officer (DPO)

Article 4.1: Data controller

Personal data is collected by the legal entity Reecall, a simplified joint stock company (SAS) with a capital of 21,394 euros, registered with the RCS of Lyon, France, under number 842 577 017.

Article 4.2 : The Data Protection Officer (DPO)

The Data Protection Officer is registered under n° DPO-143349 at the French “Commission on Information Technology and Liberties” (CNIL).

The User may contact the DPO with any questions concerning the processing of his or her data, or to exercise his or her rights, at the postal address of the Reecall SAS head office (see 4.1) or at the e-mail address : dpo@reecall.com

If, after having contacted the DPO, the User believes that his or her “Information Technology and Liberties” rights have not been respected, he or she may submit a complaint to the French CNIL or an equivalent Commission in his or her country.


Article 5: The User's rights with regard to data collection and processing

Any User concerned by the processing of their personal data may avail themselves of the following rights, pursuant to European Regulation 2016/679 and the French Data Protection Act (Law 78-17 of January 6, 1978):  

– Right of access, rectification and right to erasure of data (laid down respectively in Articles 15, 16 and 17 of the GDPR) ;

– Right to data portability (article 20 of the GDPR);

– Right to limit (Article 18 of the GDPR) and object to data processing (Article 21 of the GDPR);

– Right not to be subject to a decision based exclusively on an automated process ;

– Right to determine the fate of data after death;

– Right to have recourse to the competent supervisory authority (Article 77 of the GDPR).

To exercise these rights, the User must send a letter to the postal address cited in 4.1 or by e-mail to the DPO cited in 4.2

In order for the data controller to comply with the User's request, the User may be required to provide certain information, such as: first and last names, e-mail address and account, personal space or subscriber number. Where applicable, the User must be able to provide proof of identity.

The User is invited to consult the cnil.fr website for further information on his/her rights.


Article 6: Conditions for modifying the Privacy Policy

The Site editor reserves the right to modify the present Policy at any time in order to ensure its compliance with current legislation.

The User is invited to consult this Privacy Policy each time he/she uses the Site, without any need for formal notification.
